By accessing or using the website at avemariaconcreteandmasonry.com, or by requesting or accepting services from Ave Maria Concrete & Masonry, you agree to be bound by these terms and conditions. If you do not agree with any part of these terms, please do not use our website or services.
Ave Maria Concrete & Masonry is a masonry and concrete contractor based in Ave Maria, FL. We provide residential and commercial masonry services including, but not limited to, foundation repair, chimney repair, brick and stone work, driveway pavers, retaining walls, fireplace installation, walkway construction, and related concrete and masonry work.
All services are subject to a written estimate and scope of work agreed upon by both parties prior to the start of any project. We reserve the right to decline any project at our discretion.
Estimates provided by Ave Maria Concrete & Masonry are based on a reasonable assessment of the work described at the time of the estimate. Estimates are not guaranteed fixed prices unless explicitly stated in a signed written contract.
The final price may change if the scope of work changes, unforeseen conditions are discovered during the project (such as hidden structural damage, buried obstructions, or conditions not visible at the time of the estimate), or if material costs change substantially between estimate and project start.
We will notify you in writing before proceeding with any work that materially exceeds the original estimate. You have the right to approve or decline additional work before it begins.
We make every reasonable effort to honor scheduled project dates. However, scheduling is subject to change due to weather conditions, prior project delays, material availability, or other circumstances outside our control. We will notify you as early as possible if a scheduled date needs to change.
If you need to cancel or reschedule a confirmed project, please notify us at least 48 hours in advance. Cancellation with less than 48 hours notice may result in a fee to cover labor and material preparation costs already incurred.
We reserve the right to cancel or suspend a project if site conditions are unsafe, if access to the property is not available as agreed, or if payment terms are not met.
Payment terms are specified in the written estimate or contract for each project. For most projects, a deposit is required before work begins, with the remaining balance due upon completion. Specific deposit amounts and payment schedules are outlined in the project agreement.
Final payment is due upon completion of the work and delivery of any agreed documentation such as warranty information or permit records. Balances not paid within the agreed terms may be subject to late fees and may result in suspension of warranty coverage.
We accept payment methods as specified in the project agreement. We reserve the right to place a lien on the property in accordance with Florida law in the event of non-payment.
Ave Maria Concrete & Masonry warrants that all work will be performed in a workmanlike manner consistent with industry standards. Specific warranty terms, including duration and coverage, are stated in the written project agreement.
Warranties do not cover damage caused by acts of nature (including hurricanes, floods, and extreme weather events), misuse or modifications made by others after project completion, normal wear and tear, or conditions that existed prior to our work that were not disclosed or visible at the time of the estimate.
Except as expressly stated in the written project agreement, all services are provided "as is" without additional warranties of any kind, express or implied.
To the fullest extent permitted by Florida law, Ave Maria Concrete & Masonry shall not be liable for any indirect, incidental, consequential, or special damages arising from our services or from your use of our website, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising out of or related to our services shall not exceed the total amount you paid us for the specific project giving rise to the claim.
You are responsible for providing accurate information about the scope, location, and condition of the work site. You are responsible for ensuring that we have lawful access to the property on the scheduled work dates. You are responsible for obtaining any required HOA approvals before work begins.
If permits are required for the work, the project agreement will specify who is responsible for obtaining them. Failure to disclose known site conditions that affect the scope or safety of the work may affect warranty coverage and project costs.
